General Terms and Conditions

The NSAC is not a travel organisation and works with volunteers. The NSAC organises courses and other training activities.

Establishment and content of the agreement

  1. An agreement between the student and the NSAC is established when the NSAC has received a fully completed registration form, the signed general terms and conditions and the full deposit within the specified period from the student within the registration period.
  2. The content of the agreement is also determined by the information in the NSAC publications applicable in that season. Obvious spelling errors, printing errors and/or mistakes on the website, in brochures or other promotional material do not bind the NSAC.
  3. Participation in the NSAC Winter Courses is subject to meeting the entry requirements of the relevant course.
  4. The NSAC reserves the right to select students in the event of over-registration. If selection is made, the selection criteria will be communicated to the students prior to the selection.

Payment:

  1. The deposit for the course must be paid within 5 working days after signing the registration.
  2. The full course fee must be paid before the start of the relevant Winter Program component.
  3. The course price mentioned in the promotion is an approximation of the costs to be incurred. Depending on the number of students and the availability of instructors, students may have to pay an additional amount or have an amount left over. In all cases, any deficit or surplus within the students of the same type of course will be settled.

Cancellation by the participant:

  1. Cancellation can only be communicated in writing, whereby the date of receipt is considered the cancellation date.
  2. In the event of cancellation, the following cancellation costs will be charged:
    – in the event of cancellation up to the closing date of registrations is free of charge
    – in the event of cancellation from the closing date up to 56 days before departure 50% of the course fee;
    – in the event of cancellation from 56 to 28 days before departure 75% of the course fee;
    – in the event of cancellation from 28 days before departure the full course fee.

Cancellation and changes by the NSAC.

  1. If the number of participants after the closing date is less than the minimum number of participants as set in the budget, the NSAC may decide not to proceed with the course.
  2. Due to circumstances such as bad weather, avalanche danger, poor conditions and in cases of force majeure, it is possible that a course will be changed, cancelled or postponed. The management of the relevant project or the NSAC DB will decide on this.
  3. If a project is cancelled, participants are entitled to a refund of that part of the amount they paid that has not yet been spent on the project.

Obligations of the participant.

  1. The participant must be a member of the NKBV when he or she participates in the NSAC Winter Programme.
  2. The participant must take out adequate mountain sports insurance or another insurance with mountain sports cover. In addition, the participant is advised to cover themselves against all possible forms of cancellation by taking out cancellation insurance.
  3. The student is obliged to comply with all instructions from the instructors and/or guides deployed by the NSAC in order to guarantee the proper execution of the agreement.
  4. The student is obliged to report to the NSAC all relevant personal circumstances that may affect the smooth running of the course. This concerns in particular relevant medical and physical details.
  5. The student must behave in such a way that no hindrance or inconvenience is caused that significantly hampers or may hamper the execution of the course. The student must not endanger the safety of himself or others by his behaviour or use of incorrect material, or by treating nature and the environment in an irresponsible manner.

Rights of the NSAC

  1. The NSAC, or the instructor(s) or guide(s) deployed by the NSAC has (have) the right to exclude a student from (further) participation if the student does not or has not fulfilled the obligations stated in article 5. The resulting costs are for the account of the student in question.
  2. The NSAC reserves the right to use photographic or other recordings made during the course for promotional purposes.

Liability

  1. Participation in NSAC courses is at your own risk. Except in the case of intent or gross negligence, the NSAC is not liable for any form of damage or consequential damage suffered by the student as a result of accidents that occur during courses, unless and to the extent that legal exclusion is not permitted.
  2. The NSAC is not liable for damage or any other disadvantage caused by an act or omission of the student himself.
  3. The NSAC or SAC is only liable for damage resulting from a material defect in the facilities provided by him if this defect can be attributed to him, unless this defect is not due to his fault, nor is he responsible for it by law, a legal act or generally accepted views in society.
  4. The participants are fully responsible for damage to and/or loss of property of the NSAC and SAC and/or the accommodation where they are staying.

The NSAC is not liable for:

  1. circumstances that can be attributed to the student. Inadequate health or condition, inadequate personal equipment, incorrect actions or inaction, overestimation of one’s own abilities or ignoring instructions.
  2. consciously or unconsciously allowing oneself to be classified in an incorrect course category.
  3. failure to comply with one or more safety regulations
  4. actions and influences of third parties not directly involved in the agreement.
  5. The student is expected to take out appropriate travel, accident and cancellation insurance. The NSAC accepts no liability for damage for which a claim exists or must be deemed to exist under the insurances mentioned in the previous sentence.
  6. During the courses, the NSAC accepts no liability for loss or damage to the personal belongings of the student.
  7. If the NSAC is attributable to a shortcoming in organizing a course, a claim for reimbursement of the course fee exists.
  8. All exclusions and limitations of liability apply equally to instructors deployed by the NSAC.
  9. If, during an NSAC course, a circumstance unexpectedly occurs that leads to liability on the part of the NSAC, that liability will be limited to the insured amount(s) to which the NSAC liability insurance gives claim, increased by the deductible that the NSAC bears under this insurance.
